Global Access Cars Automobile Trading LLC and Global Cars Trading FZ LLC, including its parent company, subsidiaries, affiliates, joint ventures, related entities and authorized service providers (hereinafter collectively referred to as the "Company"), firmly believes in maintaining the highest standards of integrity, transparency and accountability in relation to the information provided by its customers, users, visitors and all other persons interacting with the Company through its website, mobile application, branches, customer support channels, auction platforms, or any related services.

You confirm that this authorization is freely given, specific, informed, and unambiguous in accordance with Article 5 of Federal Decree-Law No. 45 of 2021 on the Protection of Personal Data and Federal Law No. 6 of 2010 on Credit Information.

You further represent that the information furnished by You is lawful, accurate, true and not misleading, and does not violate any applicable law or contractual restriction binding upon You. You acknowledge that You are responsible for ensuring the authenticity of the information submitted by You, and that the Company may rely upon such information for the purposes of providing its Services, subject always to applicable law.

1A. Lawful Basis for Processing

The Company may process Your Personal Information where such processing is necessary for:

Performance of a contract;

3. Types of information received by the Company

The Company may collect, receive, generate, store, process or otherwise handle the following categories of information about You:

9A. Credit Information and AECB Authorisation

In connection with any financing request or credit-linked transaction, the Company may collect, access, and process the following credit-related information from AECB and other authorized sources:

Your AECB credit report and three-digit credit score;
Details of existing credit facilities, loans, overdrafts, and financial obligations;
Repayment history, payment behaviour, and record of bounced cheques;
Default records and enquiry history with other financial institutions;
Telecom, utility, and government payment data held by AECB where applicable;
Any other credit-related data permissibly held or reported by AECB under Federal Law No. 6 of 2010 and its Executive Regulations.

In strict accordance with Federal Law No. 6 of 2010 on Credit Information and Cabinet Resolution No. 115 of 2021, Your credit information and AECB data shall be accessed and used exclusively for the purpose of creditworthiness assessment, financing eligibility evaluation, and related compliance purposes. It shall not be used, shared, or circulated for any other purpose without Your separate, specific, and informed consent.

You acknowledge and agree that in the event of a default on any financing facility availed through or facilitated by the Company, the Company and/or its licensed financing partners reserve the right to report such default to AECB and any other credit reporting authority as required or permitted under Federal Law No. 6 of 2010 and Cabinet Resolution No. 115 of 2021. Such reporting may adversely affect Your AECB credit score and Your future credit eligibility with financial institutions in the UAE.

Your credit application data and related personal information may be disclosed to the following categories of authorized third parties strictly for the purposes set out in this section:

UAE-licensed banks and financial institutions;
Authorized financing and leasing partners;
Al Etihad Credit Bureau (AECB) and any other credit information agency authorized under applicable UAE law;
AML, fraud prevention, and KYC service providers;
Regulatory authorities including the CBUAE and UAE Data Office, where required by law.

You acknowledge and agree that:

Financing approval is at the sole discretion of the Company and/or its licensed financing partners and is subject to their independent credit assessment criteria;
AECB is not a decision-maker and does not approve or reject any financing application;
The Company is not obligated to disclose the reasons for rejection of any financing application;
You have no right of appeal against any financing decision made pursuant to this section;
A credit enquiry made pursuant to this authorization will be recorded in Your AECB report as an enquiry, which may be visible to other lenders.

10. Disclosure to third parties

The Company may disclose Your information or part thereof to third parties under the following circumstances:

To service providers, vendors, contractors, consultants, or business partners who support the Company's operations including but not limited to vehicle inspections, logistics, finance, insurance, registration, warranty, analytics, hosting, communications, payment processing, customer support, fraud prevention, and legal compliance;
To regulatory authorities, law enforcement agencies, courts, tribunals, government departments, tax authorities, or other competent authorities where disclosure is required under applicable law, regulation, legal process, or enforceable request;
To affiliates, parent entities, subsidiaries, or joint venture entities for legitimate operational, compliance, reporting, or service purposes;
In connection with mergers, acquisitions, restructuring, financing, sale of assets, or corporate transactions, subject to appropriate confidentiality safeguards;

19. Archived Content, Cached Data and Third-Party Retention

If You submit reviews, comments, testimonials, ratings, or other public content through the Website, such content may remain visible in cached pages, archives, backups, quotations, screenshots, or copies retained by third parties even after deletion from the Website. While the Company may remove content from active display in accordance with its policies, the Company cannot guarantee deletion from all external systems or third-party reproductions.

Notifying affected data subjects directly where the Data Breach is likely to pose a high risk to their privacy, confidentiality, or security, describing the nature of the breach, its likely consequences, and steps taken to mitigate harm.
